Terms and Conditions for using Personalised British English online English tutoring service
1. Account and Eligibility
- Users must create an account to access tutoring services.
- Only persons legally capable of entering contracts may use the service; minors require parental/guardian consent.
- Users must provide accurate personal and payment information.
- Account access must not be shared with others.
2. Service Description and Booking
- Details of tutoring services (subjects, session length, platform used) are specified on the website or communicated at booking.
- Sessions are conducted online using specified software (e.g., Webex).
- Students must provide relevant information to tailor the tutoring (e.g., grade level, goals).
3. Payment Terms
- Fees must be paid in full at the time of booking, prior to the lesson. Failure to pay fees in advance may result in cancellation of the lesson.
- Prices are shown in British Pounds. When using the translation tool prices may be shown in your countries currency.
- Cancellations and rescheduling requests must be submitted at least 24 hours prior to the scheduled lesson time. No fees will be charged for cancellations or rescheduling made within this period. If the lesson cannot be rescheduled within four weeks from the original date, the paid lesson fee will be refunded, less any non-refundable processing fees. Processing fees refer to the fees of the payment service used. Cancellations or rescheduling requests made less than 24 hours before the lesson may be subject to fees or forfeiture of the lesson fee.
4. Responsibilities and Conduct
- Tutors are required to possess the necessary qualifications and ability to provide quality instruction.
- Tutors must maintain an appropriate technical setup, including adequate internet speed and hardware.
- Both tutors and students must adhere to professional conduct and actively participate in sessions.
- Child safety and privacy policies apply and must be strictly followed.
- Failure to comply with these responsibilities and policies may result in disciplinary action, including removal from the program.
5. Liability and Disclaimers
- The service provider limits its liability for any outcomes, including but not limited to exam results, to the fullest extent permitted by applicable law.
- The service provider is not liable for any damages or losses resulting from technical failures, actions of third parties, or events beyond its reasonable control (e.g., force majeure).
6. Intellectual Property and Use of Materials
- Session recordings may be made for quality control or administrative purpose.
7. Privacy and Data Use
- Handling of Personal Data
We are committed to protecting your privacy and handling your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Personal information collected during the course of providing our tutoring services will be used solely for the purpose of delivering and improving our services, managing your account, and communicating with you.
- Consent for Recording and Data Processing
By using our services, you expressly consent to the recording of tutoring sessions where applicable, for quality assurance, training, or educational purposes. You also consent to the processing of your personal data as described in our Privacy Policy. You have the right to withdraw your consent at any time by contacting us, subject to any legal or contractual restrictions.
8. Miscellaneous
- Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
- Amendments to Terms and Notifications
We reserve the right to amend these Terms at any time. Any changes will be communicated to you via email or through a notice on our website. Continued use of our services after such amendments constitutes your acceptance of the revised Terms.
